These Terms of Service govern your access to and use of the Renegade Model Railroading website, online store, products, and related services.

Throughout these Terms, “Renegade Model Railroading,” “we,” “us,” and “our” refer to Renegade Model Railroading. “You” and “your” refer to any visitor, customer, or other user of our website.

By accessing our website, creating an account, or placing an order, you agree to these Terms of Service and our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, you should not use our website or services.

1. Eligibility

By using our website or placing an order, you represent that you are at least the age of majority in your state or country of residence, or that you have permission from a parent or legal guardian.

You may not use our products, website, or services for any illegal or unauthorized purpose.

2. Online Store Terms

You agree to provide current, complete, and accurate information when placing an order or creating an account.

You are responsible for:

• Keeping your account information and password secure.
• Providing an accurate billing and delivery address.
• Updating your contact and payment information when necessary.
• All activity conducted through your account.

We reserve the right to refuse service, cancel accounts, limit purchases, or cancel orders when reasonably necessary to prevent fraud, abuse, unauthorized resale, or violations of these Terms.

3. Product Information

We make reasonable efforts to display product descriptions, photographs, measurements, colors, specifications, and availability accurately.

However:

• Product colors may appear differently depending on your screen or device.
• Manufacturers may change packaging, specifications, parts, or product appearance without notice.
• Product photographs may include scenery, track, rolling stock, accessories, or other items that are not included unless specifically stated.
• Scale, dimensions, compatibility, and minimum-radius information should be reviewed before purchase.

You are responsible for determining whether a product is suitable for your layout, equipment, scale, electrical system, or intended use.

We reserve the right to correct errors, inaccuracies, or omissions and to update product information at any time.

4. Model Railroad Product Safety

Many model railroad products are intended for adult hobbyists and collectors. Products may contain small parts, sharp components, electrical components, magnets, adhesives, chemicals, or other materials that can present hazards if misused.

Products containing small parts may not be suitable for young children.

Always follow the manufacturer’s instructions, warnings, age recommendations, and safety information. Adult supervision should be provided when appropriate.

Renegade Model Railroading is not responsible for injury, damage, or loss resulting from improper assembly, installation, modification, operation, storage, or use of a product.

5. Prices and Payments

All prices are listed in the currency shown on the website and may change without notice.

Applicable taxes, shipping charges, customs duties, and other charges will be displayed or calculated when possible before checkout.

You agree to pay all charges associated with your order. By submitting payment information, you represent that:

• You are authorized to use the selected payment method.
• The information provided is accurate.
• The payment provider may process the transaction.

Payments are processed through Shopify and applicable third-party payment providers. We do not directly store complete credit-card information.

6. Pricing and Listing Errors

Occasionally, a product may be listed with an incorrect price, description, image, availability status, or specification.

We reserve the right to correct an error and cancel or refuse an affected order, including after an order has been submitted. If payment has already been collected for a canceled order, the amount paid will be refunded to the original payment method.

We will not substitute a different product without your permission.

7. Order Acceptance

Submitting an order does not guarantee that the order has been accepted.

We may decline, limit, or cancel an order for reasons including:

• Product unavailability.
• Pricing or listing errors.
• Suspected fraud or unauthorized payment.
• Incorrect billing or shipping information.
• Supplier or inventory problems.
• Purchase limits.
• Orders believed to be intended for unauthorized resale.
• Violations of these Terms.

If we cancel an order after payment has been collected, we will issue an appropriate refund.

8. Order Cancellations

Order-cancellation requests must be submitted as soon as possible to:

An order may be canceled only if it has not entered processing or shipped. We cannot guarantee that a cancellation request will be received before fulfillment begins.

Once an order has shipped, it must be handled according to our Return and Refund Policy.

9. Shipping and Delivery

Shipping timeframes are estimates unless expressly stated otherwise.

Delivery dates may be affected by:

• Carrier delays.
• Weather.
• Holidays.
• Incorrect addresses.
• Customs processing.
• Supplier delays.
• Events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges caused by an incorrect or incomplete address may be the customer’s responsibility.

If we cannot ship within the promised or legally required timeframe, we may contact you regarding a revised shipping date, cancellation, or refund, as required by applicable law.

10. International Orders

International customers are responsible for reviewing local import restrictions before ordering.

The customer is responsible for any applicable:

• Customs duties.
• Import taxes.
• Brokerage charges.
• Handling fees.
• Government assessments.

These charges are not included in the purchase price unless expressly stated.

We are not responsible for delays caused by customs authorities or for orders refused, seized, or restricted by the destination country.

International orders are final sale and cannot be returned or exchanged, except where applicable law provides otherwise.

11. Returns and Refunds

Eligible domestic returns are governed by our separate Return and Refund Policy.

Domestic customers generally have 14 days from delivery to request an eligible return. The buyer is responsible for return shipping, and no restocking fee is charged.

Damaged or incorrect orders must be reported within three days of delivery.

Our Return and Refund Policy is incorporated into these Terms by reference.

12. Product Availability

Product availability is not guaranteed.

Items may become unavailable after an order is placed because of inventory errors, supplier changes, discontinued products, or simultaneous customer purchases.

We may limit the quantity of any product sold to an individual, household, geographic area, reseller, or order.

13. Preorders, Backorders, and Special Orders

Products identified as preorders, backorders, or special orders may have estimated availability dates.

Those dates are estimates and may change due to manufacturer, distributor, transportation, production, or supply-chain delays.

Unless otherwise stated, other products ordered with a preorder or backordered item may be held until the entire order is available. Contact us before ordering when separate shipment is required.

Special-order or customized merchandise may be nonreturnable, as explained in our Return and Refund Policy.

14. Manufacturer Warranties

Some products may include a warranty provided by the manufacturer.

Any manufacturer warranty is subject to the manufacturer’s terms, exclusions, procedures, and time limits. Renegade Model Railroading does not extend or replace a manufacturer’s warranty unless expressly stated in writing.

Customers may be required to contact the manufacturer directly for warranty service.

15. Personal and Commercial Use

Unless otherwise stated, products purchased through our store are sold for personal hobby, collection, display, or ordinary resale use.

You may not:

• Copy or reproduce our website content for commercial use.
• Use automated systems to scrape product information or pricing.
• Misrepresent yourself as affiliated with Renegade Model Railroading.
• Use our name, logo, photographs, or branding without written permission.
• Purchase products through fraudulent or unauthorized means.

16. Intellectual Property

All website content owned by Renegade Model Railroading—including our name, logo, graphics, layout, photographs, written descriptions, and original materials—is protected by applicable intellectual-property laws.

Manufacturer names, product names, trademarks, logos, photographs, and other materials belong to their respective owners.

You may use our website only for personal, noncommercial shopping and informational purposes. Nothing in these Terms transfers ownership of intellectual property to you.

17. Reviews and Customer Content

You may submit reviews, photographs, feedback, comments, or other content when the website allows it.

You agree not to submit content that:

• Is false, fraudulent, defamatory, threatening, obscene, or unlawful.
• Violates another person’s intellectual-property or privacy rights.
• Contains malware, spam, advertising, or deceptive links.

You retain ownership of your original content. By submitting it, you grant us a nonexclusive, worldwide, royalty-free license to display, reproduce, and use it in connection with our store and marketing, subject to applicable law.

Nothing in these Terms prohibits or penalizes an honest customer review.

By using the website, you acknowledge that information may be processed by Shopify and other service providers as necessary to operate the store, process orders, prevent fraud, provide customer service, and fulfill transactions.

21. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis.

We do not guarantee that:

• The website will always be uninterrupted or error-free.
• Every product description or image will be completely free from error.
• Every product will be compatible with every layout, system, or piece of equipment.
• Website defects will always be corrected immediately.
• Third-party services will remain continuously available.

Nothing in these Terms excludes any warranty or consumer right that cannot lawfully be excluded.

22. Limitation of Liability

To the fullest extent permitted by law, Renegade Model Railroading and its owners, employees, representatives, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website, products, or services.

This may include loss of profits, data, business opportunities, goodwill, or property.

Where liability cannot legally be excluded, our liability will be limited to the amount you paid for the product or service giving rise to the claim, unless applicable law requires otherwise.

This limitation does not apply where liability cannot lawfully be limited or excluded.

To the extent permitted by law, you agree to indemnify and hold harmless Renegade Model Railroading and its owners, employees, representatives, contractors, and service providers from claims, losses, liabilities, damages, and reasonable expenses arising from:

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies posted on the website, constitute the agreement between you and Renegade Model Railroading concerning use of our website and services.

These Terms are governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law principles.

Nothing in this section limits any consumer right or protection that cannot legally be waived under the law applicable to the customer.
